James (“Jim”) Whitmire, recently inducted into the American College of Trial Lawyers as a Fellow, is a second-generation attorney with nearly 30 years of experience litigating a wide variety of matters ranging from simple cases involving individuals and small business owners to complex litigation matters involving Fortune 100 companies, multi-million dollars in dispute and hundreds of thousands of documents.

Jim has successfully represented clients in complex commercial litigation matters, insurance coverage disputes, professional liability matters, receivership cases, class action cases, employment disputes, real estate cases, and tort-related matters.  He has acted as lead counsel in trials, arbitration and appellate matters. On numerous occasions, Jim has served as a “lawyer’s lawyer” representing attorneys in various matters.  Jim has also acted as “active” local counsel with major national law firms.

Jim has also served as a private mediator, arbitrator, special master and consulted as an expert witness.  Jim is expanding his practice to take a more active role in these matters.

One year out of law school, acted as appellate counsel seeking to “gain experience” and obtain reversal of criminal conviction on a “manifest weight of the evidence” argument, which surprisingly led to a 2-1 decision in favor of reversal in reported case People v. Verkruysse, 639 N.E.2d 881 (Ill. App. Ct. 1994)

Only three years out of law school was a key member of team in a month-long jury trial of employment class action “pattern and practice” case examining key fact witnesses, statistical experts and handling jury instructions (after taking and/or defending approximately 75 depositions).

Successfully represented local police department in insurance coverage matter involving late notice/prejudice issue. Nevada Supreme Court en banc decision reported as Las Vegas Metropolitan Police Department v. Coregis Ins. Co., 256 P.3d 958 (Nev. 2011)

Successfully represented major hotel/casino owner in case involving right of access with argument before the Nevada Supreme Court. En banc decision reported as Slade v. Caesars Entertainment Corp., 373 P.3d 74 (Nev. 2016)

Active member of team involving national counsel with argument before the local district court defeating class action certification involving wage and hour matter concerning a major national retailer.

Member of trial team in successful case involving $10 million jury verdict on breach of “implied in fact” contract matter with primary responsibility for jury instructions involving unique fact pattern and underdeveloped area of law.

Active member of group of lawyers in receivership matter where nearly 100 cents on the dollar was recovered for a case where approximately $100 million was at issue. Jim’s part of the case involved insurance coverage matters.

Acted as counsel for receiver in matter involving 2 insolvent insurance companies where numerous asset recovery actions were filed including director and officer claims, professional liability claims, reinsurance and other matters.
